At this morning’s hearing the judge set yet another date (August 26 at 8:30) for yet another status hearing. She did indicate that she wants the trial to begin in late September. We will have to wait (again) and see…
Not much going on- I have decided to skip the Zimmerman trial- it’s too divisive. Plus I am taking an on-line class right now…
The hearing for Arias motions is in 8 days…I am guessing they will postpone the trial AGAIN! I just hope it’s in October or something, not next year! I feel terrible for the Alexanders.
The Sneiderman case is coming (I think July 28). This is going to be good!! Andrea Sneiderman had her boss, Hemy Neuman (who we believe she was having an affair with) kill her husband Rusty. Hemy went to trial for the crime- Andrea testified in his trial and was defiant on the stand. Hemy ended up in jail. So she hooked up with her OTHER boyfriend, Joseph Dell!!! Well her husband was dead and her lover in jail so what’s a girl to do?
The defense has filed 2 new motions- one to vacate death eligibility and the second to vacate the aggravating factor. One of the primary reasons cited in the motions by the defense is the use of the word ‘especially’ in the phrase: “especially heinous.” Nurmi contends that use of that word implies the statue was designed for a judge, not a jury. He said that ‘layperson jurors’ are left to ‘muddle through’ the definition with a defendant’s life in the balance. Maricopa County Attorney called this a standard procedural move: “Those are defense attorneys doing their job advocating for their client,” Montgomery said Wednesday. “Obviously, we disagree.”

Just to remind everyone, this will not be live streamed and most of the hearing will be held in chambers and sealed. Jodi just came in wearing her gray prison striped outfit with salmon socks. The courtroom is full of chatter. Flores and Juan were just summoned back into chambers. Everyone is coming out of chambers. Jodi Arias has full umbrella bangs and makes a clanking noise as she walks. She went to her room.

@WildAboutTrial: The armed sheriff seems to be clearing Jodi Arias’ table. She is brought out now and is sitting down. There are 4 fully armed sheriff deputies here to keep an eye on Jodi Arias. These are some serious deputies. Wow. Jodi Arias is sitting with the DP mitigation specialist whispering. Sheriffs haven’t left her side. Jodi Arias did not seem to have a smile on her face, looked rather tired. Attorneys are back. Judges Stephens is present and addressing the court now. Court is deferring the ruling on the motion to delay the trial until July 18. The hearing is over.

Both Tara Kelley and Marilou Allen said on the Dr. Drew show tonight that they will be in court for Thursday’s hearing. They both said they are ‘still invested’ and want to ‘see this through.’ Tara was an alternate but Marilou was in on the deliberations. Marilou said the jury went into deliberations (on the Murder 1 charge) without preconceived notions and debated the felony and the premeditation aspects of the case. She also mentioned the ‘sheer brutality of the murder, underscored by Dr. Horn’s testimony.’ When asked about the defense’s asking for a delay Tara said it was ‘ridiculous.’
Both women are still approached by friends and people in the community to talk about the case. They are slowly getting back to their lives.
The hearing this Thursday (8:30 AZ time) should address the delay request. It will not be live streamed but the pool and still cameras will be there.
According to ABC15.com’s Corey Rangel, the prosecution has filed a motion asking the judge to deny the motion for a delay filed by the defense. They defense had said they needed time to find other witnesses to stand up for Jodi (they have had 5 years) and that they had scheduling conflicts. Martinez responded: ““Neither reason warrants a continuance of the proceedings until the first part of next year.” For more here’s the link:

Jury hung on penalty phase of trial. New jury will need to be selected. Found guilty of 1st degree murder. Ex-girlfriend charged with the murder of former boyfriend Travis Alexander in Mesa. I did hear on Websleuths that cameras would be there, but this says no one has requested them yet. Hopefully the judge will not allow the defense to push this trial into next year! The woman who refused to be on camera in court (and then refused to testify at all) is showing up on HLN again. If she is so terrified and getting death threats then why is she on Jane Mitchell’s show and slated to be on Dr. Drew tomorrow night? Last time I checked death threats were illegal and those that give them can be tracked and prosecuted. If I was worried for the safety of myself and my daughter I would not be on TV at all. I would distance myself from Jodi and this case altogether.
Personally I don’t buy it. The day she actually showed up in court to testify for Jodi in the Penalty phase she backed out when Juan questioned her. Patty refused to answer questions about whether she and Jodi did drugs together. (She went out into the hall with the defense attorneys and returned saying she wanted to ‘take the fifth.’)
These were not her lawyers and were not supposed to give her any advice. A lawyer was later brought in for her. I did not hear it, but I bet he also brought up her DUI arrest for Heroin. She was also questioned about the monies she received from the Nancy Grace show- remember she showed the video of Jodi at her wedding? Well she apparently forgot to claim the money she received! Oops! (Though I don’t know if it is true, someone said she is on welfare and she was supposed to tell them she got that money).
I also heard that she was not properly dressed for court, and that they tried putting a sweater over her but it wasn’t good enough. If I were Jodi I would NOT want his mess standing up for me!

I find this interesting as I remember someone brought up Mr. Martinez writing a book and If I remember correctly he said that he was too busy being a prosecutor to write a book.
