Session 1:

1. JM (Juan Martinez) is going over her scenario to the jurors of what happened on the 4^th.  She told the jurors that she wasn’t sure if Travis stopped to pick up his camera.  JM indicates that would have given her even more time (to get away).
2. JM is trying to discern when exactly her ‘fog’ set in and if she can remember anything.  She had said that her brain ‘freezes’ and she doesn’t hear words but this time she did hear Travis say: “F’n kill you bitch.”
3. JM says her scenario is impossible given the time stamps on the photos (62 seconds for the entire event).  He claims she did not have the time to do all she did and then all the stabbing as well.
4. JM points out that because she testified that she did not know where the knife was she would have had to take some time to go and find it…unless she had it right there with her. (She implies maybe Travis had the knife).  He reviews that she said they both went down after the gunshot and neither had a knife at that point.  That means according to JM that Travis was down and she had to go get the knife and then come back to him to attack him with it.
5. This entire time she has been mincing words and arguing details of the questions with Martinez.  She does not appear to shake and drinks water easily.  Also Nurmi is doing a lot of objecting.

Session 2:

1. JM brings up the fact that she does remember having the knife in her hand at one point.  She argues with him saying she doesn’t remember gripping the knife…eventually she has to admit it must have been in her hand for her to have dropped it and remembered the sound of it hitting the tile floor.  She doesn’t want to agree with anything JM has to say.
2. JM asks her about where her shoes went- did she leave them behind as she did not have them on when she stopped in the desert.  She does not remember.
3. JM gets her to admit she put gas in the car on the way to Nevada but then she back tracks and says she must have, but she does not remember.  He is trying to prove she used the gas cans at that point.
4. JM mentions that everything that has something to do with the case she managed to get rid of.
5. Doesn’t remember if the gun was in a holster or box—she says there never was a box.
6. She admitted buying a gun for protection for a camping trip with all guys (though she claims they were still asking people and there eventually may have been some girls).  JM says she did not need to go on the trip (why go if you are so afraid you need a gun?) She claims her violent encounters with Travis were part of the reason for the gun.
7. JM brings up her claim to have read and followed the Book of Morman.  When it came to caffeine she stopped drinking it.  JM had her read about lying and she had to say that if you lie you are “more or less condemned to Hell.”
8. JM brings up fight after Dan Freeman removes items from her backpack (they argue over when the actual fight started).  She had said Travis said “Fuck you” to her that day and that was when she realized he was not father material but JM got her to admit she had used the exact same words against Travis.
9. JM got her to admit she had no problem ignoring the Law of Chastity even when she was clear on it saying (re: sex) if it’s wrong I don’t want to be right.

10. JM asks again about why she never called 911 regarding abuse from Travis.  They went over the incident with Bobby and her 911 call.  She admits there was nothing stopping her from calling 911.  She also admits she never took any pictures of injuries although she did take pics of her hurt finger from work.  She says she didn’t take pics because she was ashamed of those.

11. JM points out that the closet shelves are sitting on pins (and he throws in they are made to hold 40 lbs).  He points out if she had put her weight on like she said the shelf would have tipped over.  But nothing on the shelves is out of place.  She insists she just stepped on the edge briefly.

12. They go back and forth over whether she thought the gun was loaded (her story was ‘unloaded’ to the jury earlier, now she’s not so sure). JM asks her “if you thought the gun was unloaded what were you going to do with it…throw it at him?”

13. JM tells her you know you have to have your finger on the trigger to shot the gun.  He says: “You shot him in the head and killed him right?”  and she answers “yes”.

JUROR QUESTIONS AND ANSWERS (paraphrased):

1. How many times did you see Travis’ gun?  Three- one when I discovered it, another time when cleaning and June 4.
2. Re: Derald and guns…he showed you the safety.  Did you practice? I didn’t even touch it.
3. Were you and Matt living in separate cities while he was with Bianca? Yes.
4. Was it possible you were on a break or broken up at the time? I guess it’s possible…we were intimate…we didn’t break up.
5. If you still felt threatened by (Travis) why did you use a knife instead of just shooting again? I dropped the gun when he hit me…we fell..I don’t remember picking up the knife.
6. You said you remember putting the knife in the dishwasher…but you also don’t remember anything after dropping the knife.  Which is correct? I have a vague memory of putting a knife in the dishwasher…I’m not sure if that is the memory of June 4…or a prior incident.
7. Does being baptized generally require that you follow the doctrine…in The Book of Morman? Yes.
8. Did you take photos of injuries to your neck? I took a photo of myself in the U-Haul…I know I had makeup on …to hide the bruises.  I was trying to not make a record of them.
9. How many phone calls, texts and e-mails were exchange between you and Travis on June 3 & 4? Between 5 and 9 phone calls…texts were not saved or recovered and no e-mails.

Follow up- Nurmi:

1. She admits she wasn’t a ‘perfect Mormon’ and did see the Bishop about her sexual transgressions.
2. She said the neck injuries were not captured in photos as they were something she wanted to forget, that this was against the Law of Attraction and it could hurt Travis.  She also said she sometimes felt ashamed and that she had provoked it.

Follow-up- Martinez:

1.  She said she was not broken up with Matt when she confronted Bianca but JM said she told her Social Worker something different.  She denied it.

2. JM confirmed that she told the Bishop about the sex but failed to mention the murder.

NURMI:

1. N (Nurmi) brings up the laws of Chastity and Attraction.
2. He goes over her many breakups and how they were not violent.

4. JM starts asking about her RH finger injury from her job at Casa Ramos.  She claims she got a bandaid from the manager but never filed any work injury report as they were a small business (4-5 restaurants).  JM does not buy it.Session 2:

11. During these altercations, why didn’t you just scream in hopes that someone would hear you and come help you?

13. If you were scared of what TA was capable of doing, why would you ever allow him to tie you up?

Session 1:

1. JOURNAL:  She indicates she would not have put the pedo incident in her journal.  In journal she mentions being ‘haunted by it’ and says: “I cannot marry him…something’s off with that boy.” She says she would have been worried about her children.  She also claims Travis said if he could marry her he would ‘win the wife lottery.’  She felt anxiety about (moving) and  ‘leaving him to his own devices.’
2. She called a lot of people “Hottie-Biscotti.”
3. She sent the Grandma of Travis Iris’s as she was the only one she had met in the family and she felt doing nothing would look worse.
4. VIOLENCE:  Travis banging his head in one incident and hitting her car in another.  The car incident was after Disneyland and they were stuck in traffic.  She says Travis was hitting the steering wheel and screaming at the other drivers.  She was “shocked” as this was the first time she saw his temper.
5. SEX:  N mentions the intercourse while asleep again- she says it was a mistake.  Then the arm grab and bend over incident- she says it was better than the violence escalating.
6. ROBBERY:  N asks would she have had access to other guns- her  “yes.” She mentions several people she knows with guns and a number of guns her father had (one with a silencer).
7. She choose to rent a car from Redding as it was the only place offered at priceline.  Says she could have borrowed a car from friends or family.  Also Redding was on her way.

Session 2:

1. N goes over gas receipts.  She says she topped off the tank.
2. License plate story is repeated.
3. Now her story is she needed the gas cans for the trip on I 15 as she had never driven it and was worried she would get stuck in the desert.
4. N reviews all her (alleged) violent encounters with Travis.  He points out that she shkes and has memory issues related to these encounters.
5. Asks if Travis was a runner- No
6. N shows her face from the nude photo- asks if she was comfortable there- No.  She is not sure where the rope went.  She introduced KY for the painful sexual encounters.  Travis refused to buy it- didn’t want to be seen.  Travis had as “all access pass” to her body.

Session 3:

1. Though she admitted to the stabbing she does not actually remember it.  Says they were her actions, her responsibility.
2. Claims she never told Mr. Violet (sp) that Travis was watching kiddie porn on his computer.
3. DAY OF MURDER:  Claims Travis did not shave the day of the murder. Does not remember if she lost any consciousness after she was tackled. Doesn’t recall shaking at that time. Claims she remembered the time he ‘almost killed her’ and that went through her mind. He is screaming at her.  She doesn’t remember a knife. Doesn’t remember the cleanup or the dragging.  Does remember screaming and dropping the knife. N asks her in several ways if she went to Travis’ on June 4 to kill him, she says no.  She felt she had no choice.
4. AFTER THE MURDER: N asks why she sent texts- she knew she did something wrong. And was scared.  Says it’s not okay to kill under any circumstance.  Says part of her wishes she was the one dead.
5. Regarding lying afterward- it wasn’t her goal to evade, just didn’t want people to know she could do this and that Travis could be violent.
6. N talks about there being lots of secrets ‘behind these doors’ (shows diagram of Travis’ bedroom.  She agrees they had a secret life with sex and violence in it. Even after arrested she kept these secrets for years. N implies she would rather die than expose these secrets.  N asks if it was her desire to reveal all this in front of a jury and national audience- No. N rests.
7. Judge says there are about 100 jury questions the 2 sides will review tomorrow morning.  The jury will be back in court at 1 pm.

Session 1:

1. N (Nurmi) begins with JA taking responsibility by testifying including admitting that she did kill Travis (in self defense).
2. N tries to show that her finger looks the same in photo as it does now if she is in the same position (demonstrated with attorney). She also shows a picture of an injury to her right hand index finger from June she says she got from moving margarita glasses (implying this is what Ryan saw in Utah).  She doesn’t recall having any injury to her left hand in Utah.
3. N leads her through some texts and the memorial note she left about praising Travis.  Talks about how their relationship went from sex to romantic love to platonic love. Mentions the time she woke up and Travis was in her.  She felt put on a pedestal and N brings in pedestal at one time and on the ground (being kicked) at another time. N brings up the Law of Chastity and she reminds us that Travis told her anal and oral were okay.
4. Though broken up she was still concerned about STD’s and that is (supposedly) now why she wanted to confront Travis after seeing him with another woman.  Then she went on to say he had given her the okay to stop by that night.  She also said that she later did not to confront Travis because he chastised her, therefore she was in fear and felt intimidated.

Session 2:

1. N brings up when JA saw a girl through the window.  JA felt Travis was still courting her as he (according to her) promised to change, went out on dates, went out on his birthday, and he gave her the money to move to Mesa as well as storing some of her stuff.
2. Talk about her weekend with John Dixon.  Travis was upset as Dixon was not a church member.
3. SEX:  N is trying to prove that Travis has had previous experience with women.  All of this is based on her word.  She had said after first oral sex (on her) that he knew what he was doing.  She said he led her to believe he had had more partners than her.  She felt the BJ in the car wasn’t his first time as he put the visor down to see in the mirror.  She said he bragged about knowing the female anatomy. Says he also compared her to another woman.   Her prior history re: anal was 4 times before she met Travis.  She says she didn’t ask for anal after the baptism and it was painful- no lube, may have used spit. Says she enjoyed the physical part of sex “sometimes.”  N goes through a list of times when JA only did the sex act to pleas Travis, such as the Toblerone after the “facial and her feeling like a prostitute” after the weekend of sex.  She says she continued to have sex with Travis after the pedo incident to help him feel normal. She explains the ‘horny school girl’ text she sent him as part of a long text where they were trying to outdo one another. She says she had never dressed up for anyone until Travis.  N brings in an edited piece of the sex tape.  It has what I would call highlights of some of the graphic stuff said by Travis, including the tying to a tree and the cream pie (which she says she had never heard of).  She says she wasn’t comfortable with taking pics  (or video) unless they would be deleted.  She claims she did many things she did not enjoy just to please Travis.
4. Regarding fidelity- she was not disloyal to Travis by making out with Ryan as they weren’t boyfriend/girlfriend at the time.  She claims Travis was with other women when they were still having sex.  She implies Travis wanted a 3-some with some girl named Shetanya (sp) and is cut off by the prosecutor.  This never comes back up.

Session 3:

HER JOURNAL:  JA explains that some pages have been torn out by her; in one case due to a description of a weekend she had with Dixon.  Apparently Travis (who she claims read her Journal) was upset over it. She also said the Mormons were big on Journals and she wanted someday to pass it down.  She explains that due to the ‘Law of Attraction’ she didn’t want to put anything negative in her Journal, also because Travis might read it.  And she was protecting Travis so no mention of abuse or pedo incidents. Also the law of Attraction says if you want positivity then be positive and so that is why she put only positive things about Travis.  N shows the August 26 entry where she says: “I love Travis so completely I don’t know any other way to be…” and there are highlights.  JM objects.  She writes about not tolerating negative statements about her friends or Travis.  Later she talks of her range of emotions and suicide he (Travis) makes me sick and he makes me happy…this darkness is the result of my own creation.  “I just wish I could die.”

Session 1:

1. Changed her story on when her luggage was taken out- now she’s not sure when, but after 2pm.
2. On Direct she said it was Travis’ idea to take the shower photos but she told Detective Flores that “It took a lot of convincing” and he first said “No” then “I feel gay.”
3. He shaved before the pictures were taken and that is when she convinced him to do the photo shoot.
4. This was a camera she had never used before.
5. JM showed the seated photo of Travis (still alive).  At first she said the shot was inadvertent but it was in focus and aimed at him so she admitted she took it on purpose.
6. Picture with the water on his face.  She admitted this  entire shoot was her idea- like a “Calvin Klein ad”, and she was directing the poses. (So she got him seated so he’s more vulnerable.)
7. Says she was kneeling for these last 2 shots then dropped the camera, he stood up called her a “F’n idiot,” looked really angry and picked her up and body slammed her. She hit her head and had the wind knocked out of her.  (She is not sure if he still had one foot in the shower when she was body slammed – JM did a physical demo of this showing how ridiculous it was).
8. She remembers all this despite the head injury.
9. She says now he’s standing over her and she rolls to the left gets up.  JM says Travis could have been meaning to help her up.  She gets up and runs down the hall.  She is clothed, he is not. She has “no problem” getting away from him though she was on the floor and he was over her.  JM says “So this guy who’s in  great shape…a wrestler…can’t catch you?” She runs down the hall and goes into the closet.  She slams the door.  JM says: “You’re saying someone in great shape can’t catch you?”
10. JM shows crime scene photo and asks where were you in this photo (paraphrasing).  She begins to cry.  JM asks: “Did you cry when you shot him?”  Her: “I don’t remember.”  JM: “Did you cry when you were stabbing him?”  Her: “I don’t remember.”  JM “Did you cry when you slit his throat?”  Her: ”I don’t know.” JM: “You’re the one that did this, right?”  Her: “Yes.” JM: “And You’re the one that lied about all this, right?”  Her: “Yes.”  Lunch recess called.

Session 2:

1. Previous crime scene photo is shown.  He’s feet away , she says he could touch her, she rolls then JM asks: “You were able to get up?”  Her; “Yes.”
2. She runs.  At first she says she didn’t know if he was following her then she says she thought she heard footsteps.   JM asks: “Did you hear footsteps?”  Her: “yes.”  JM  says: “So he is coming after you…you’re scared and this man who’s in shape can’t catch you?”  Her: “Yes.”
3. She runs into closet and slams the door.  JM says:  “You can’t see through the door…how do you know he’s still mad?” She admits she doesn’t know what he’s doing but she goes for the weapon. JM says: “You’re inside the closet, he’s on the other side of the door”.  Establishes that she has time to think- run out the other door of the closet or get the gun.  The door is just as close- she could have kept running, then went down the hall, down the stairs and out.  But instead she puts one foot on a shelf and reaches up and grabs the gun with one hand, never using the other hand for stability. JM show picture of the pristine closet where nothing, not the shoes, the clothes, the ties, not anything is disturbed. JM asks how tall she is- 5’6”. The shelf is up higher than the doorframe.  JM says she said previously that the gun is kept at the back of the shelf. The closet measures 11 ½ feet. ( He says that’s small- she says it’s bigger than the cell I live in.  He calls her on her attitude.) That means she had a good head start.  She claims he was coming through the door as she went for the gun.  JM mentions she said he did not have a gun then confronts her about bring the gun from Yreka. She denies it. JM-She had a head start when he is entering and she choose to escalate the situation by getting the gun.  (IMO this is critical – shows pre-med  even with her story).
4. She goes into the center of the bathroom and turn sand points the gun as he is running in.  She mentions the wet floor and JM puts the pic of the dragging and shows her that she had socks.  JM points out Travis was naked and wet so slippery for him.
5. JM points out it would have been closer for her to run out of the bathroom than to run into the middle of the bathroom stop and turn around.  She has the gun in both hands and he’s running at her.  Both called it a “defining moment.”
6. JM changes the subject to some of the last texts.  He points out nowhere on the texts or in e-mails does Travis ever threaten her physically.  She did threaten to sock him- but she claims it was a joke.  Mentions the fight with Travis about Dan taking things out of her backpack.  She claims Travis started that fight but JM says her attitude started it.
7.  Back to the gun/lunge…JM is establishing the distance between her and Travis 9 feet.  He’s running at her and lunges and the gun goes off.  His head is down as he lunges.

Session 3

1. She demonstrates the “tackle”.  JM points out that even though she is on the ground she was able to get away from ‘this wrestler.”
2. She can’t remember how the camera was moved.  She admits she must have put it in the washing machine. JM indicates it shows her mental state that she: deleted the photos, put it in the machine.  Also deleting the photos isn’t a one step process and she hadn’t used Travis’ camera before. She had the thought process and the mechanical ability to remove the pictures. Deleting the pictures would help only her.  All this in ‘A fog.’
3. JM says she knew he was dead.  That there was no one else there.
4. A glass was moved from under the sink (she was cleaning up).
5. No blood after the end of the hall- she cleaned herself up.
6. JM pointed out there was no record of her having been in Arizona. She said “Surveillance cameras.”
7. They argued over whether she used the gas cans in AZ.
8. She stopped before the checkpoint, tossed the gun.  JM – There was no need to take the gun if in a fog. JM mentions grandpa’s gun again.
9. She admits she did something wrong to Travis.

CLEAN-UP/COVER-UP

1. No knife was found so she must have taken it. She admits Travis was stabbed.
2. JM asks if he (Travis) was stabbed in the back (and shot in the head) he would be no threat.
3. She admitted she cut his throat.
4. JM asked why she took the rope if it wasn’t part of the murder and she was in a fog.
5. She changed her clothes and washed her hands.
6. She made some calls, including one to Ryan (lying about her cell phone charger.) JM- She still had the ability to think to protect herself.  JM: “You would have been satisfied (relieved) avoiding any of the consequences of killing Mr. A.”  Her “That was my goal that day. Sent a text to Travis about cashing her check.  JM- No reason to leave a dead man a text.
7. Left a long e-mail to Travis on June 7…”hope you weren’t upset I didn’t come to see you…”

Last Part:

1. JM called her out on Travis being hypersexual saying she gave as good as she got.  He said she enjoyed the sex (she said yes) even though she had spent days and days talking about how bad it made her feel.
2. JM called her out on the lack of proof (and nothing written in her journal) about physical abuse.
3. JM says she believes she’ll be acquitted because she told these stories.
4. JM shows the clip with “No jury will ever convict me…because I’m innocent.”  He asks if it is no jury will convict because of the suicide or because she’s innocent?  She agreed these are 2 different statements.

Session 1:

SEX:

1. First she said it was not a romantic weekend but today she admitted she “enjoyed it.”
2. She said Travis told her he had sex with other women but that is her word and no other women ever confirmed it.
3. On the sex tape Travis said: “Before I met you I never jacked off.”
4. She was in control of the recording of the sex tape as well as owning it.  Travis never had the tape.
5. JM said Travis never knew he was being recorded.  She denied it.
6. She never erased the tape and could have posted it on the internet.
7. During the playback of parts of the sex tape today she never hid her face and did not appear embarrassed.
8. She did not object to being woken up with oral sex on the tape but on Direct she said she didn’t like being woken up with sex.
9. She admitted that they were both into it (sex).
10. In texts she was sexually aggressive: If you’re a lucky boy you can give me a spanking…and ass a too much needed pounding-kidding”.  Went she got the penis picture she texted “That is so freakin hot I want to lick it up and sit on it.”
11. SCHOOLGIRL TEXT (important):  She texted Travis: “I want to fuck you like a dirty horny schoolgirl”  implying it was HER fantasy.  Travis did not force her to wear a schoolgirl outfit.
12. JM asked “Did you enjoy dressing up for him?” and she said “yes.”
13. The sex tape was full of fantasies like the tie to a tree or the porn tape.
14. Both knew this was against LDS but did it anyway.
15. Her pet name for Travis was “Hottie Biscotti” but she then used the same for Ryan after being intimate on their first day together.
16. A text with Ryan she said she adjusted him not the other way around.  She then texted “I will gladly give it to you.”
17. JM has proven (IMO) that she was the sexual aggressor.

RE: MURDER/TRIP:

1. She told several different accounts of the murder to Detective Flores and 48 hours.  There was no mention of memory loss.
2. One version she was trying to save Travis. (48 hrs)
3. She said she had a plan regarding her trip but also told 48 hrs that she did not have a plan and went with the wind.
4. She said she rented a car in Redding because it was cheaper but JM implied it was because as she had stated that Yreka was a small town where everybody knew everybody’s business.
5. She said she got a white car to avoid speeding tickets (as they are expensive) but JM implied it was because she wanted to be inconspicuous. She ended up with a white car.
6. JM asked her “Wouldn’t it have been more convenient to rent in Yreka?” and she said “No.”
7. She said she had between $80-200 cash for the trip.

Session 2:

TRIP:

1. Brewer said on the stand that she told him she was going to Mesa and she needed gas cans.  She says that is wrong.
2. She said gas cans were to save money on gas by buying it in Nevada or Utah but she filled them in California were it was more expensive.
3. She bought a 3^rd gas can in Salinas but says returned it.
4. JM showed 3 gas receipts from one Arco station were it appears she filled her car, then 2 cans, then put some gas in a 3^rd can.
5. She had enough gas in her tank to get to Nevada an fill the cans there.
6. She called Ryan and Matt and never mentioned she was going to see Travis.

CALL:

1. She called Det. Flores 1 day after the body was found to find out what was going on in the investigation and to get suspicion off her.
2. She says she knew she was being recorded.
3. She told Det. Flores Travis had no guns, he wasn’t into that.

GUN:

1. Told JM that she found Travis’ gun in Fall 2007
2. JM asked if it was loaded.  She said Travis said it was not.  He asked her where the ammo was.
3. She said a small gun was stolen from her Grandfather’s house along with $30.  When JM mentioned about her laptop not being taken she said she had it with her- directly contradicting the Yreka police who found it in a laundry basket at the scene.
4. She admitted the gun would fit in her purse.

LICENSE PLATE/STARBUCKS

1. Kept changing her story on the plate on cross.
2. First it was lying flat then later it was tilted up.
3. There were other cars and lights in the parking lot.
4. Said she saw a reflection while backing out so she got out and picked up the (dirty bug infested) plate and put it in her car. JM asked her why she took a plate that she did not know who the owner was as she never compared it to the back plate (upside down).
5. Got in the car and locked it because she was concerned for her safety.  JM asked if you were concerned for your safety why get out of your car to get something reflecting?

Session 3:

TRIP:

1. She called Travis and texted him and he ‘guilted’ her into seeing him.  She admitted she was flattered by this.
2. JM asked “Why call him if you’re going to Utah.”  “Why keep exposing yourself to him if you are going to see another man?”
3. JM asked if she filled her tank, the 2-5 gal. cans and another 2= gals. And she said: “Yes.”
4. So far she spent at least $180 in gas.
5. She admitted sex was one of the reasons she wanted to see Travis.
6. She said they had sex, used the rope then took photos.
7. She said Travis cut the rope in the bathroom.  JM asked “How did he know where to cut it?” and “Why cut it if you are just going to tie the ends into nooses?”  (So no knife needed).
8. JM shows the sex photos right after “rope” event and there is no sign of a rope.  Arias says she doesn’t know where it went.
9. She also told Richard Samuels that Travis put the knife on the night stand in his bedroom.
10. JM asked about deleting the sex photos and the so called video that was on her camera.
11. She took a shower after sex.  JM asked her if she took a shower in the same place where she put his body after she killed him. Her:  “Yes.”
12. She was unclear as to when she took her stuff out to her car and what she took.

Jodi Arias vs. Juan Martinez (Day Three) summary

Session 1

Patterns in Relationships:  Assertive, Confrontational, Dishonest

1. Bobby:  At 17 she went into his hotmail behind his back.  She read an e-mail from a woman in New Orleans so she canceled work and immediately went to Bobby and confronted him.  She left him for a few days then went back.

2. Matt:  Saw a girl’s photo and heard he was cheating.  Immediately left work and then drove 11/2 hours to confront the girl who she had never met.  Did this without Matt’s knowledge.

3. Brewer:  Dumps him within 4 days of meeting Travis.

4. Travis:  Saw him with a girl while looking in the back window.  Confronted him the next day even though they were not boyfriend and girlfriend.

5. Travis:  Went into his phone when he was asleep and saw texts with 2 other women.  Despite the fact she felt it was cheating she still went on vacation with him.

6. Travis:  She was living in Palm Desert and went to Mesa to see Travis.  She looked at his my space account without his permission.  She said this made her “unhappy”.  They were not dating at the time.

7. Mom:  Came to Mesa to see her.  Jodi did not like her excuses and ‘negativity” so she told her Mom to go back home.

8. Ryan Burns:  Talked on the phone and texted then she drove to his home (from Yreka Ca. to Utah) to see him and they were very quickly intimate.

Other issues:

1. Fighting with the prosecutor:  Mincing words like “gave” the letter vs. “showed” the letter.  Also she implied the prosecutor was scrambling her brain again.

2. Sex:  “Forgot” to tell her legal assistant that she had also has anal sex with Bobby.

3. Religion:  She had a HUGE problem with Travis joking about sex with a supposed married woman because it is against the tenants of the church but she had no problem having all kinds of sex with Travis.  Claimed she knew the former was not okay but not the latter.

Session 2

1.Showed a picture with her and Travis in it where she is heavier, blonde and nearly as tall as Travis.

CONTRADICTIONS:  Between her portrayal of Travis as mean, deviant and abusive vs. her actual comments.

2. 48 hours interview she says she’s “angry and outraged his life was taken” and that he never got to finish all the great things he wanted to do.  He was “a light…he brightened the room.” He was “a great guy.”

3. After breaking up and moving away she sent him this text:  “I thank you for being such an amazing friend you are a rock, a light and an inspiration.  …Thank You, Thank You, Thank You.”

4. At the memorial:  “You’re beautiful on the inside and out.” (Martinez then said “So you think a (pedophile) is beautiful on the inside?”)

SEX:  The sex was mutual and sometimes led by her.

1. She introduced KY to make the sex even better.

2. If there was anything she did not like she could have stopped it at any time (and did once).

3. 48 hours tape she says: “The sex was ALWAYS mutual.”

4. In a text she says: “I want to give you a nice BJ and I’d like a generous facial in return.”  This is directly contrary to the “felt like a prostitute statement” when this same act was performed previously.  It also demonstrates her asking him for sex.
