Despite the “I want the Death Penalty” interview right after the verdict the defense attorneys have filed a motion that the victim impact statements be presented via videotape. This will lessen the emotional impact on the jury. It also denies the rights of the friends and family of the victim to confront the murderer. I personally do not think the judge will let this motion happen.

Court Cancelled Today
No court until next Wednesday. The rumor I am hearing is that since Jodi gave an interview 20 minutes after being found guilty where she claimed she wanted to get the Death Penalty she has been under a suicide watch. There is a possibility they are checking out her competency to go forward.
Jodi Speaks-Her First Interview
About 20 minutes after the verdict Jodi Arias met with ‘MyFoxPhoenix’s Troy Hayden. He said she was ‘shaken’ and crying. She said she didn’t have a direct message for the jury but that she had prayed for them. When asked her response when the verdict was read she said: “I think I just went blank.” She also mentioned being overwhelmed and having to take it one day at a time. She said that there was ‘no pre-meditation on my part’ but that she could see the felony murder because of ‘how the law was written’. When Troy mentioned the jurors not believing her story she said she could understand as she had told lies. She reiterated that she would prefer the death penalty because ‘The worst outcome for me would be natural life…longevity runs in my family.’ She also said she hopes Travis’ family has ‘greater peace.’ Another part of this interview is coming up at 5:30–watch the live stream at:

Aggravating Circumstances
Facts that make a crime worse or more serious by such circumstances as the facts of the crime, the defendant’s prior criminal record, etc. Some aggravating circumstances are very specific, e.g., the murder of more than one victim. Other aggravators are broad, e.g., the murder was committed in a heinous, cruel or atrocious manner.
Mitigating Circumstances
Facts that do not justify or excuse an act or offense, but may reduce the degree of moral culpability, and thereby reduce the penalty. Examples include mental impairments, deprived background, etc.
Victim Impact Statements
Statements read into the record, or presented through testimony of witnesses, during sentencing to inform the jury of the financial, physical, and psychological impact of the crime on the victim and the victim’s family.

Jury Sentence Recommendations
The jury considers the aggravating and mitigating circumstances surrounding the crime and the defendant and returns with a recommended sentence. In a death penalty case, the jury chooses between a death sentence and a lesser sentence of life without parole, life, or a term of years.
Judge Sentencing
After considering the jury recommendation, the court formally pronounces punishment on the defendant. In some states, the judge must follow the jury recommendation. In other states, a judge may sentence without a jury, or override a jury’s recommendation.

5/7/2013- Motion for discovery – Party (001) 5/8/2013
Note: Defendant’s Motion For Discovery Of Victim Impact Statement.
Apparently the defense (party 001) wants to know what the victims will have to say in advance, should there be a verdict. I have never heard of this. An attorney on Websleuths said that by statute the victim does not have to pre-disclose these statements. I expect there will be a hearing soon.

I wouldn’t say I KNOW Jodi, but I have met her, and witnessed her “handy – work” first hand. I used to talk with and ended up visiting a boy she was interested in (1997 -1998) …she broke in his house and cut the phone lines, one time while I was at his house we were in his room and she was peeping through the window watching us….She always seemed sweet and such, but you could tell something was seriously wrong just below the surface.
